Users are advised to confirm from us in advance the existence of such collaborations / affiliations/ partnerships as the same may or may not be updated time to time on the website and we do not take any responsibility of any loss, fraud, compromise in services rendered, or damage arising out of such happenings through third parties who ar not in relation with us anymore. We take responsibility of the quality & standards of service only of the individuals or entities who are registered with us, displayed on this website, and have a legal binding contract with us for providing the services as listed on this website. We do not take any responsibility of the end results of healing or consultation sessions for any of our services and claims made by us or any other individual or organization, whether connected with us or not.

• You / user/ clients / customers / students / receiver means any person above the age of 18 & not restricted, revoked rights of, barred, or blocked from using our services and the website. Eligibility

If you are under 18 years of age, you are not allowed to make a transaction on Yana’s Healing Studio or wherever the brand presence is - social media, apps etc. It is the duty of the legal guardians of all persons below 18 years of age to ensure that their wards do not make a transaction without their supervision on Yana’s Healing Studio. It shall be automatically deemed that by allowing any person below the age of 18 years to transact on Yana’s Healing Studio, their legal guardians have expressly consented to their use and we disclaim any liability arising from your failure to do so.

Any waiver of any provision of this Agreement/ OUR POLICIES will be effective only if in writing and signed by Yana’s Healing Studio and its founders.

Termination, Agreement Violations

You agree that Yana’s Healing Studio, in its sole discretion, for any or no reason, and without penalty, may suspend or terminate your account (or any part thereof) or your use of the services, website, social media, groups or communities and remove and discard on the Yana’s Healing Studio website / any associations with us of any nature or kind, all or any part of your account, your user profile, or your recipient profile, at any time. We may also at our sole discretion and at any time discontinue providing access to our services, or any part thereof with or without notice. You agree that any termination of your access to the services or any account you may have or portion thereof may be effected without prior notice, and you agree that we will not be liable to you or any third party for any such termination or interruption. Any arbitration shall be confidential, and you may not disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcing the arbitration award. All administrative fees and expenses of arbitration will be borne by you or divided equally between you and Yana’s Healing Studio, as the case may be and at our sole discretion. In all arbitrations, each party will bear the expense of its own lawyers and preparation. This paragraph shall survive termination of this Agreement.

Governing Law and Forum for Disputes

This Agreement shall be governed by Indian law. Any suit, action or proceeding seeking to enforce any provisions of, or based on any matter arising out of or in connection with, this Agreement or the Transactions may be brought in a court sitting in Mumbai, Subject to the Dispute Resolution section above, you agree that any claim or dispute you may have against us must be resolved by a court having jurisdiction in Mumbai, India. You agree to submit to the personal jurisdiction of the courts located within Mumbai, India and in accordance with the laws of republic of India, for the purpose of litigating all such claims or disputes. Each of the Parties hereby consents to the non- exclusive jurisdiction of such courts in Mumbai, India. This paragraph shall survive termination of this Agreement.

Severability

If any provision of this Agreement / OUR POLICIES is held to be unlawful, void, that provision will be limited or eliminated from this Agreement to the minimum extent required, and the remaining provisions will remain valid and enforceable.

Survival

Upon termination of this Agreement, any provision which, by its nature or express terms should survive, will survive such termination or expiration as applied to transfers and relationship prior to such termination or expiration.

Headings

The heading references herein are for convenience purposes only and they do not constitute a part of these Terms & Conditions and will not be deemed to limit or affect any of the provisions hereof.

Entire Agreement

This Agreement is the entire agreement between you and Yana’s Healing Studio relating to the subject matter hereof and this Agreement will not be modified except by a change to this Agreement made by Yana’s Healing Studio in accordance with the terms of this Agreement.

These "Policies', "Terms" and "Conditions of Use" ("Policies" "Terms/Terms and Conditions") constitute an electronic record within the meaning of the applicable laws. This electronic record is generated by a computer system and does not require any physical or digital signatures. These Terms shall be in addition to and not in derogation to any other terms as stipulated from time to time. By using our services / website, you are agreeing to and accept these Terms.

Refund Policy

• No refunds will be issued for cancellations made after 24-hours of Booking. Please ensure that you are committed to your booking before finalizing the payment.

• Once the participant / trainer pays the fees, it shall not be refunded unless there is a case of death of the participant.

Registrants for the courses cancelled or postponed by the institute, will be adjusted/ transferred to same another city on another date at no cost. In the event of such cancellation the institute is not liable for expenses incurred for travel and stay bookings.

• You are not eligible for refund for any reason if the amount is not paid in advance by you for the services.

All sales on the Yana’s Healing Studio are final with no refund or exchange permitted. You are responsible for the purchases that you make via online or offline mode and all charges that result from those purchases. You are also responsible for the information provided at the time of making the purchase and all charges that result from those purchases. We are not responsible for any purchase of incorrect value or paid in incorrect bank account. However, if a transaction is performed by you on our website, money has been charged to your card or bank account, please inform us within 24 hours of the completion of the transaction. You shall inform us by sending an e mail to our customer services e mail address mentioned on the 'Contact Us' page. Please include in the e-mail the following details - your full name, the mobile number, email id, transaction date and order number, copy of the payment receipt/screenshot. We will investigate the incident and, if it is found that money was indeed charged to your card or bank account by mistake, and credited at our end, then either we will issue you an email in writing in this regard or follow up with the payment gateway / bank to reverse the transaction back to source or you will be refunded the money within 21 working days from the date of receipt of your e mail. All refunds will be credited to the mode by which you made the payment i.e. back to source. It will take 3-21 working days for the money to show in your bank account depending on your bank's / credit card issuer's policy.

Other Terms & Conditions

Additional terms and conditions may apply in order for you to avail our specific services and to specific portions or features of the site, including contests, promotions or other similar features, all of which will be communicated as and when such services are provided by us. Indemnifications

Disclaimer, No Warranties

Yana’s Healing Studio is an organization whose purpose is to provide an individual with holistic health education. This organization includes various holistic disciplines such as healing techniques, spirituality, energy healing, meditation, aromatherapy, yoga, etc. The philosophy is a multi- dimensional approach to health, in which each individual must accept responsibility for his or her own well-being, with the understanding that the decision to learn and/or practice holistic disciplines may involve intensive cleansing, deeper understandings and realizations

1. Yana’s Healing Studio is an educational & consultation centre representing different Alternative Sciences.

2. We have no medical personnel on staff; makes no claims direct or implied, to diagnose, counsel or treat any specific medical condition that you as an individual, may currently have or may have experienced in the past.

Participating in our Fraud reporting initiative requires you to follow our guidelines. Responsible investigation and reporting includes, but not limited to the following:

In general, please investigate and report frauds in a way that makes a reasonable, good faith effort not to be disruptive or harmful to us or our users. Otherwise your actions might be interpreted as an attack rather than an effort to be helpful.

Generally speaking, any fraud that poses a significant vulnerability could be eligible for reward. But it's entirely at our discretion to decide whether a fraud is significant enough to be eligible for reward.

Eligible Reports

• Must pertain to an item explicitly listed under our in- scope vulnerabilities section or the issues which are not covered herein at all ;

Must contain enough information and a proof email, valid document, video, audio or screenshot

• You agree to keep any communication with Yana’s Healing Studio private and destroy the same once the issue has been resolved.

Rewards

• All monetary rewards can only be credited to a bank account of the reporter only after receiving valid identity proofs.

• The minimum reward for eligible frauds reporting is any of the following at our sole discretion:

1. the equivalent of 2000 INR in money or services equal to the amount

2. Special pricing on our services or workshops

Only one reward per fraud report will be given.

• Rewards over the minimum are at our discretion, but we will pay significantly more for particularly serious issues. We will also issue Certificate of recognition & lifetime discount offers to distinguished individuals.

How to report?

• Gather the proofs.

• Include as much information in your report as you can. Ideally, a description of your findings, the steps needed to reproduce it, and the vulnerable component.

Share recording of phone calls, videos, audios, screenshots or any other proof for, please upload to your own Google Drive or any other upload service and share with us the links to those files.

• Include your correct name, mobile number and email address.

Allow us up to 15 days to respond before sending another email on the matter.

What information do we collect?

A policy statement provides guidance and direction to both practitioners and researchers; empowers participants, contributors, stakeholders, coaching organizations and clients alike with regard to engaging in or utilizing research; enhances the legitimacy of Yana’s Healing Studio as a whole; serves a protective function in that it guides behaviour and, at the same time, sets boundaries; enhances decision- making; facilitates evaluation; and defines priorities.

This policy is intended to apply to Yana’s Healing Studio staff, the Yana’s Healing Studio Board and its executive, members, and academic personnel, students, clients or external vendors who wish to utilize our resources to engage in research on any aspect of the services or workshops we deal in.

Key Definitions

Research

Not all information about healing, training or coaching can be categorized as research. Yana’s Healing Studio's working definition of research is: Research (including evaluation) is defined as any activity that involves the collection, collation, review or evaluation of data or information for the purpose of describing, maintaining or modifying activities, practices, interventions, or treatments. Research may involve the manipulation of variables or environmental factors whereas evaluation more typically involves the review of information for the purpose of providing feedback about the function, productivity or efficacy of an activity. Evaluation includes but is not limited to activities including needs assessments, process assessment, outcome studies, impact analysis, cost-benefit analysis and meta-analysis.

Evidence-Based Practice

We encourages and endorses evidence-based practice (EBP) with respect to effective coaching. That is, we wants our students and coaches to make solid decisions regarding the method or technique they use based on their ability to critically assess the best available, current, valid and relevant coaching evidence before applying it to day-to-day coaching practices. We believe combining the explicit knowledge derived from sound research, broadly defined, as above, with the more tacit or experiential knowledge of the practitioner is the synergistic sine qua non of effective coaching.

We strive to collaborate with organizations and individuals that promote the establish a discipline of studies highest standards of research to establish a discipline of studies to support and further the profession. Equally we seeks to make this information available to practicing ones and those interested in the profession. Specifically, our goals are to:

• Contribute to the advancement of theory and the establishment of best evidence-based practices;

• Disseminate research to the practitioner of the related areas;

• Establish increased credibility for and as a discipline through the encouragement and support of best research practices and resulting theory development in the practice of areas we cater to;

• Close the gap between research and the practice by combining evidence-based practice with practice-based evidence

1) Market-Oriented or Industry- Related Research

This kind of research on the profession, on consultants / trainers and on the organizations often makes use of evaluative techniques and surveys conducted for the following purposes:

• To track trends in the profession so that we can best serve all the parties concerned;

• To assist the Board in making decisions regarding the future policies and directions;

• To provide information to member clients, trainers, therapists on industry trends;

• To provide valid information to media or other parties requesting information about the profession

To facilitate Yana’s Healing Studio's public relations (PR) efforts

In short, market-oriented research is our profession's way of looking at itself. Our policy is to prioritize requests for information from our members and to protect them from repeated and unnecessary demands on their time and resources. Thus, the criteria for our participation in such surveys is the importance of the information to be gathered and the legitimacy of the researcher or organization conducting the survey balanced against the time and/or other resources demanded of members or other respondents.

2) Research to Gather Evidence on Techniques, Methodologies, Outcomes and Theories

The core purpose of Yana’s Healing Studio is to advance the art, science, and practice of professional consulting & coaching in the areas we cater to. Alternative sciences is an applied profession, and its successful development requires a dialectic process among trainers and practitioners to develop a discipline that can support the profession, and vice-versa. It is assumed that a discipline requires a solid theoretical foundation that will strengthen the profession and contribute to its ongoing development. The quality of coaching theory will be determined by a vibrant research community combined with practitioners who both utilize and contribute to research inside and beyond Yana’s Healing Studio.

Therefore, for both broad categories of research on alternative sciences (delineated in 1 and 2 above), we will encourage and collaborate with researchers and organizations that are gathering evidence on any aspect of profession, given the following limitations:

• Researchers must be aware of and adhere to our Code of Ethics.

• The research must meet ethical guidelines for the treatment of human subjects;

• Our members must be protected from undue demands on their time and resources, and any requests must be consistent with our priorities and policies.

• Internal or state-of-the- profession surveys may be commissioned from time-to- time by Yana’s Healing Studio.

• Research Portal will be vetted by Yana’s Healing Studio.

Online usage & Cyber security policy

The details of member (name, contact details, email ids, phone / mobile numbers) with whom you come in contact with directly (on ground live workshops, meets, sessions or in any other way) or indirectly (through online groups, communities, workshops, our website, testimonials or by any other way) are not intended to be used to promote, market, get into collaboration with, provide similar or identical services that we provide, and/or sell your product or services by any means and in any manner without our written consent.

We expressly reserves all rights to take further action against those who violate our user agreement. We can further restrict & revoke the certifications / rights on study material or all the information shared to them by using any or all of our services and workshops happened in past or to be provided in future.

Any unlawful actions from your end to Yana’s Healing Studio or its members which is in violation of the law can give rise to criminal penalties, including imprisonment and subjects the sender to both significant civil fines and criminal penalties.

The qualifications of members/ coaches listed, and the information provided is not verified by us in any way. Individuals utilizing our or our student's trainers services are urged to take reasonable steps to verify the qualifications of any potential coach. By utilizing our member's details and directory, you agree to hold Yana’s Healing Studio harmless from any and all claims which may arise as a result of your using the information provided and agree to adhere to our Spam Policy and any other spam regulations that may apply.

All other email and electronic communications with members should adhere to the following principles:

1. You should have a prior relationship with the person receiving your email. (Someone giving you their business card is acceptable in this regard, as it implies permission to get in contact. The same is true if someone has sent you an email.)

2. A valid "from" and "reply to" address must be included with each message.

If you have a subscription list, you should send a confirmation email that the person wishes to be on the list.

3. There should always be a quick way to unsubscribe from any mail lit.

4. Any request to cease mailing from an individual or organization should be quickly honoured.

5. A complaint involving a breach of this policy may be considered a violation of the Yana’s Healing Studio's Code of Ethics, and therefore remedies may be required to make good of the same. Our decision and necessary actions will be final for such instances.

6. Please note that spam laws and regulations above and beyond our policies may apply to commercial electronic messages sent to individuals who have elected to list their contact information on our website.

Engagement as a Therapist/Trainer/ Coach

The terms and conditions mentioned below form part of additional terms and conditions which will be shared with you before engaging as a therapist/trainer/ coach with us.

We reserve right to modify, amend and alter all or part of these terms and conditions. An intimation will be given to your of such changes, should you find it not acceptable, you have the right to terminate your engagement with us.

The broad policies are listed as below:

1. In order to register as a therapist, you must have at least earned one certification from us in order to see and experience the way we impart our services & workshops. You are required to adhere to same or higher standards.

2. The registration and engagement grants right to only the person who have registered with us and not their business partners, family, affiliates, students, representatives or organization.

3. You will be required to pay a refundable, interest free security deposit to start the engagement. There will be revenue share clause as agreed in writing, depending on the service that you provide and location of such service. Royalty for using our course material may be charged extra depending on other factors.

4. We hereby expressly suggest you not to give any false commitments or promises either in writing or otherwise to the clients and we don't take any responsibility of such promises made by you.

5. We reserve the right to disclose your credentials including but not limited to your age, educational qualification, certifications, background and years of experience in a particular therapy upon request by the users as long as it doesn't conflict with our future business.

6. We are an equal opportunity platform and do not discriminate by gender, age, cast, creed, religion, language, upbringing, financial status or geographical area. And give preference and suitable weightage as per your competencies. And you are also required to maintain the same while providing your services to the clients.

7. Your association with us as a therapist, coach, healer, trainer or otherwise does not constitute a legal partnership with us. Consequently, you do not have right either in overall total revenue or equity by any way or any means with us.

8. All the legal suits or proceedings of any nature, if any, arising out of you providing your services should be dealt by you at your expense. All the legal & accounting fees or taxes will be your sole responsibility.

9. Any or all the inquiries, notices, demands or proceedings by tax or government authorities in relation to the service provided by you shall be attended and resolved by you only. You have the right to request your account statement, balance confirmation, proof of TDS/ tax payment (if it's recovered from you or deducted from your pay out), and copy of agreement/s with us or any other document which is required for closure of such proceedings as long as it doesn't conflict with our interest or does not bring a potential present or future threat on us or make us open to scrutiny by the authorities.

10. You hereby agree to provide and are bound to assist us with all the documents, proofs, evidences, account and tax statements / return copies, proof of tax payment, details of the clients served by you (name, mobile number, PAN number, address) in regular course of business and in special occasions of replying to communications by legal, tax or government authorities. The requirements mentioned here are not final and further details to be asked from you on case to case basis, as required.

11. In case of the inability of the therapist to provide details as mentioned above due to any reason (travel, moving abroad, death or any other reason), your family members, business partners or any other person who can provide such details in our knowledge will be contacted to provide the details and they are bound to do so. The same applies to us as well.

12. We reserve the right to revoke your services or engagement any time without prior notice in case of any fraudulent acts reported in your name. Our decision will be binding and final for you for resolution of such cases.

13. In order to engage as a service partner with us, where you have right to use our brand and presence and also right to use our course material, certificates, and data of existing clients, during the term, you need to bring at least 3 new healing modalities/therapies on board. Upon assessment, we may consider you to take on board as a service partner along with other terms and conditions.

14. Any inquiry or complaint from the client served by you, not resolved in reasonable and professional manner from your end, and reaching to us, will be taken seriously and acted upon. Any harm to our goodwill due to such incidences may result in you losing your lien on the non- refundable security deposit or any other amounts payable by us to you, till the time of resolution of such inquiry and / or at our sole discretion. Your engagement may be put on hold in such cases to protect our goodwill. Furthermore, any cost in relation to resolution of any dispute which was raised by the clients served by you, will be recovered by Yana’s Healing Studio from you and you agree to pay the same or take proceedings further from your end and at your own expense.

15. Reporting of fraudulent practices done by you along with proof may result in you losing your lien on security deposit and any other amounts payable to you. You also lose your right as an appointed therapist with us. We reserve the right to notify people via any means of communication, including but not limited to social media, text messages, WhatsApp, calls, newspaper and emails about such termination of the engagement in order to protect our goodwill.

Referral credits policy

DEFINITION:

REFERRER: A person who is an existing client of YANA’S HEALING STUDIO and has purchased our courses or services.

REFEREE: A person who is not an existing client of YANA’S HEALING STUDIO and who has given their approval and whom the Referrer has referred to through the scheme.

RULES: The referrer must refer to our services in good faith and only with the results we commit to. If we find out that the referee has made unrealistic claims about our courses or services, we reserve the right to refuse the referral credits in its entirety.

This policy applies to all the referrals i.e. clients that came to us via recommendation via word of mouth, email, social media, or otherwise. This policy does not apply to existing clients or returning clients.

1. We respect and honor you for trusting in us as you and your loved ones' transformation partner; hence, this policy is a small gesture of appreciation for your trust in us

2. If you refer anyone for any of our services or workshops, and the person pays 100% amount in advance, then you get 10% of the receipts as a credit to be utilized against any of our services/workshops, OR you can opt to receive the money as a direct bank transfer.

3. Receipt of he entire 100% amount in advance is a necessary condition to avail yourself of the referral credits.

4. This policy does not apply to payments made by existing clients or returning clients.

5. This policy does not apply to person making the payment i,e. the person making the payment cannot take 10% credit on their own energy exchange.

6. The payment will be made via bank transfer or against our services only. NO CASH PAYMENTS ARE ALLOWED.

7. You may have to produce your identity proof i.e. PAN Card and AADHAR CARD for INDIA, and identity documents as applicable for your country if we find it necessary to keep the same for future tax inquiries.

8. If requested, you may have to submit an invoice, against which we will make the payment.

9. In case of disputes between the individual who has availed himself of the services and our therapists, we have the right to keep the referral payments on hold until dispute resolution.

10. For international payments, submission of identity proof is mandatory.

11. We have the right to keep the payments on hold or refuse the payments altogether in case of fraudulent practices. Our decision will be final and binding in such cases.
